These Terms of Service (“Terms”) explain the rules for using ShaderGif (the “Service”), including our website, editor, gallery, and any related features. They’re written for visitors, creators, and anyone who publishes or shares shader-based GIFs, JavaScript sketches, or other generative artwork through the Service.
1) Acceptance of these Terms
By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation, and “you” in these Terms refers to the organisation as well.
2) Who we are and how to contact us
“ShaderGif”, “we”, “us”, and “our” refer to the operator of the Service. If you need to contact us about these Terms, your account, or a legal request, please use our contact page.
3) Changes to the Service or the Terms
We may update the Service (for example, adding/removing features, changing limits, or improving security). We may also update these Terms from time to time. When we do, we will update the “Last updated” date at the bottom of this page. Continued use of the Service after changes means you accept the updated Terms.
4) Accounts and access
- Account accuracy: If you create an account, you agree to provide accurate information and keep it up to date.
- Security: You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account.
- Eligibility: You must be able to form a legally binding contract in your jurisdiction to use the Service. If you are under the age required for consent in your country, use the Service only with a parent/guardian’s permission and supervision.
5) The editor, rendering, and technical limitations
The Service may allow you to write and run code (for example GLSL shaders, JavaScript, or p5.js) to preview output and generate GIFs or video previews. You understand and agree that:
- Code execution and rendering performance vary by device, browser, GPU, drivers, and settings.
- Some code can crash a browser tab, consume significant CPU/GPU resources, or cause high memory usage.
- We may set limits (such as frame count, resolution, file size, or timeouts) to protect the Service and other users.
- Features like draft saving and “last session” recovery may rely on browser storage and are not guaranteed backups. You should keep copies of your important work.
6) User Content: what you own and what you grant to us
“User Content” includes any code, text, titles, descriptions, comments, images, textures, uploads, and generated outputs (including GIFs and previews) that you submit, publish, or otherwise make available through the Service.
6.1 Your ownership
You keep any rights you have in your User Content. Nothing in these Terms transfers ownership of your User Content to us.
6.2 Permission you grant to ShaderGif
To operate the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt (for example, transcode or resize), display, publish, and distribute your User Content via the Service. This includes making your published GIFs viewable in the gallery, generating previews, and enabling sharing links.
This licence is limited to running and improving the Service. If you delete content (where deletion is available), we will take reasonable steps to remove it from public-facing areas, but you understand that caching, backups, and third-party shares may persist for a period of time.
6.3 Your responsibilities
You represent and warrant that:
- You have the rights necessary to upload and publish the User Content you submit (including any third-party textures, images, audio, code snippets, or libraries).
- Your User Content does not violate any law, regulation, or the rights of others (including copyright, trademark, privacy, or publicity rights).
- Your User Content complies with the “Prohibited uses” section below.
7) Prohibited uses
You agree not to misuse the Service. This includes (but is not limited to):
- Uploading or publishing content that is unlawful, hateful, harassing, or that promotes violence.
- Uploading content that infringes intellectual property rights or violates privacy rights.
- Attempting to bypass limits, security controls, or access restrictions.
- Probing, scanning, or testing the vulnerability of the Service, or attempting unauthorised access to accounts or systems.
- Using automated means to scrape, overwhelm, or degrade the Service (for example, abusive crawling, spam, or denial-of-service behaviour).
- Distributing malware, harmful code, or content intended to compromise devices, accounts, or networks.
- Impersonating others, misrepresenting your affiliation, or otherwise deceiving users.
8) Moderation and enforcement
We may review, remove, restrict, or disable access to User Content or accounts at our discretion to protect the Service, comply with law, or enforce these Terms. We are not obligated to monitor all User Content, and we do not guarantee that content will be reviewed before it appears publicly.
9) Copyright complaints
If you believe content on ShaderGif infringes your copyright, please contact us with enough information to identify the work, the allegedly infringing material, and a way to reach you. We may remove or disable access to content where appropriate and may terminate repeat infringers in suitable circumstances.
10) Open source notice
ShaderGif has an open source history and may include components released under open source licences. Where applicable, those licences apply to the relevant source code and govern your rights to use, modify, and redistribute that code. If there is any conflict between an open source licence and these Terms regarding the source code, the open source licence controls for that code.
11) Paid features, trials, and refunds (if offered)
Some features may be offered as paid plans in the future (for example, higher rendering limits or private drafts). If paid features are offered, additional terms (including pricing, billing cycle, and cancellation rules) may be presented at purchase time and will form part of your agreement with us.
12) Third-party services and links
The Service may rely on third-party services (for example, hosting, analytics, CDN, email delivery) and may link to third-party websites. We are not responsible for third-party services or their content, and your use of them may be governed by their own terms and policies.
13) Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, secure, error-free, or that generated outputs will be preserved indefinitely.
14) Limitation of liability
To the maximum extent permitted by law, ShaderGif will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or revenue, arising out of or related to your use of (or inability to use) the Service.
Where liability cannot be excluded, we limit our liability to the minimum permitted by applicable law.
15) Indemnity
You agree to indemnify and hold harmless ShaderGif from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your breach of these Terms.
16) Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service (including accounts) if we reasonably believe you have violated these Terms, pose a risk to the Service, or where required by law.
17) Governing law
These Terms are governed by the laws of the jurisdiction where the Service operator is established, without regard to conflict-of-law principles. If you are a consumer, you may also benefit from mandatory protections under the laws of your country of residence.
18) Privacy
Our handling of personal information is described in our Privacy Policy and Cookie Policy. By using the Service, you acknowledge that you have read those policies.
